Reproduction, sale and distribution of sound or audiovisual recordings, software, images and texts protected by law without the consent of right holders shall be prohibited and punishable, including by imprisonment.
Piracyis a general term used to describe a deliberate violation of the law on copyright and related rights consisting in the unauthorized reproduction and exploitation of such rights-bearing products.
According to theLaw no.1459-XV of 14.11.2002 on Distribution of Copies of Works and Phonograms,exploitation, manufacture or distribution of copies of works or phonograms infringing the copyright and related rights shall be deemed illegal.
Importation of illegal copies of works or phonograms in the Republic of Moldova without the consent of the holders of copyright and related rights from the countries where they were not protected or their term of protection has expired shall also be deemed illegal.
In order to legally act the distributor must have:
- an invoice certified by the signature and stamp of the right holder;
- a certificate of registration in the State Register of Holders of Control Marks;
- a certificate for obtaining control marks;
- a contract that allows distribution of copies of works or phonograms.
Evidence proving that CD/DVD is pirated:
- Lack of control mark issued by AGEPI;
- Lack of trademark used by local right holders;
- Lack of information on rights management in a work or phonogram;
- The quality and sharpness of the image represented on the cover, the properly printing packaging.
